Information on personal data

In accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016.  on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46 / EC (general regulation on data protection, hereinafter: "GDPR"), we would like to inform you that:

  3. Your personal data is processed: 

    a. in order to take actions aimed at concluding a contract, such as submitting an offer, correspondence on agreeing the terms of the contract, etc. pursuant to art. 6 sec. 1 lit. b) GDPR

    b. for recruitment purposes, to assess the qualifications to work for the position for which the job was applied for, to assess the abilities and skills needed for the job;

    c. to implement contracts concluded with the Administrator, including employment contracts and internal management, monitoring of electronic communications to protect against malware and activities harmful to business in cyberspace

    d. in order to fulfill the legal obligations incumbent on the Administrator, e.g. issuing an invoice, storing accounting documentation, etc.

    e. in order to test customer satisfaction which is the implementation of the Administrator's legitimate interest, determine the quality of service and the level of customer satisfaction of the Administrator with the products and services offered pursuant to art. 6 sec. 1 lit. f GDPR

    f. implementation of the legitimate interest of the Administrator pursuant to art. 6 sec. 1 lit. f GDPR

    g. in order to possibly establish, investigate or defend against claims being the implementation of the legitimate interest of the Administrator pursuant to art. 6 sec. 1 lit. f GDPR

    h. for archival (evidence) purposes which are the implementation of the Administrator's legitimate interest in securing information in the event of a legal need to prove facts pursuant to art. 6 sec. 1 lit. f GDPR)

     

  4. With regard to the processing of personal data in order to fulfill the legal obligations incumbent on the Personal Data Administrator, the obligation to provide data is a statutory requirement; in turn, in the case of data processing for the purpose of concluding and performing the contract and for purposes resulting from legitimate interests pursued by the administrator or a third party - providing personal data is voluntary, but it is necessary to conclude and perform the contract with the Law Firm.

     

  5. INTESA Małkowski Wojdak i Partnerzy Radcowie Prawni, depending on the specific purpose, will process the following categories of data:

    a. data to confirm identity, such as name and surname, PESEL number, ID card number, date of birth;

    b.  contact details, such as: telephone number, email address, home address, IP;

    c. tax identification data

    d. data on education and professional experience - if it is necessary from the point of view of the services provided

    e. data on the property and financial situation - if it is necessary from the point of view of the services provided

    f. data on professional and economic activity

    The data may be made available to authorities authorized to process this data on the basis of legal provisions, as well as entities with which the Administrator cooperates, e.g. companies from our capital group, suppliers of technical and organizational services (e.g. IT service providers or security services), and these entities they process data on the basis of a contract with the Administrator and only in accordance with his instructions.

     

  6. Your personal data will be kept until there is a basis for their processing, i.e .:

    a. in the case of data necessary to perform the contract - for the duration of its performance and the time necessary for the parties to this contract to implement claims arising from it

    b. in the case of necessity to protect the vital interests of the data subject or another natural person - until these interests are realized or expire

    c. if the basis for data processing is the legitimate interest of the administrator - as long as this legitimate interest exists.

    In any case, however, personal data will not be processed for a period shorter than the statutory period required for the storage of a given type of information.

     

  7. ​ The recipients of your data may be:

    a. attorneys, legal advisers, notaries, trainees and apprentices as well as other entities providing legal services and independently deciding on the purposes and methods of data processing cooperating with the Law Firm

    b. entities authorized under applicable law - selected state institutions, authorities or performing public tasks;

    c. the purchaser of the law firm's receivables

    d. entities providing IT, payment, accounting and financial, audit and control, postal and courier services.

     
  8. INTESA Małkowski Wojdak i Partnerzy Radcowie Prawni generally does not transfer personal data outside the European Economic Area. The Law Firm informs, however, that it may be necessary to transfer personal data to a third country in the manner and under the conditions specified by applicable law. The above may take place in the case of, for example, ordering the performance of specific IT services or tasks to service providers based outside the European Economic Area.

    e. object to the processing of personal data

    f. withdraw consent to the processing of personal data, but its withdrawal does not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal.

     

  11. You also have the right to lodge a complaint with the supervisory body (the President of the Office for Personal Data Protection - ul. Stawki 2, 00-193 Warsaw).
